Freejoy User Agreement

Article 1. Users' Service

Users must (i) read through and accept this Agreement before installing, downloading, visiting or using Freejoy in any other way, and (ii) download Freejoy from websites or media appointed by us. Freejoy has no obligations or liabilities on any possible risks and/or losses caused by Users' breach of this Agreement.

Article 2. Intellectual Property

2.1 We are the copyright owner of Freejoy. All intellectual property rights related to Freejoy, as well as information content, including but not limited to dramas, text representations and combinations thereof, icons, graphic decorations, images, charts, colors, interface designs, layout frameworks, associated data, additional programs, printed materials or electronic documents, are protected by copyright laws and international copyright treaties as well as other intellectual property laws and regulations. Users shall not reverse engineer, decompile, or disassemble Freejoy without our prior written approval.

2.2 Users acknowledge that any dramas, texts, images, graphic materials of the network service provided by Freejoy are protected under copyright, trademark and/or other property ownership laws. Without the prior written approval of us, foregoing information shall not be used for any other commercial purposes. All or any parts of the information shall only be available for private and non-commercial purpose to be saved in Users' terminals. Freejoy has no obligations or liabilities to any Users or third parties on any damages and/or losses caused by (i) the delays, inaccuracies, errors, omissions of the information, or (ii) during the transmission or submission of the information or any parts hereof.

Article 3. Registration and Account

3.1 When users first use Freejoy on their personal device, we will assign a unique UID to users automatically. Users can login and bind this UID with Apple account, Google account or Facebook account. This will ensure the security of users' account assets, help users check their viewing record and unlocked (purchased) drama history.

3.2 If users uninstall Freejoy without logging in and binding their UID, all the information (including but not limited to behavior records, viewing records, unlocked drama history, purchased history) and assets under his/her Freejoy Account may be permanently deleted. When users install and use Freejoy again on a different device, we will assign a new UID to him/her. Users shall be solely responsible for any consequences arising from a UID change due to actions such as data erasure, application uninstallation, or reinstallation.

3.3 Users have the right to delete his/her Freejoy Account, but all the information (including but not limited to behavior records, viewing records, unlocked drama history, purchased history and assets under the Account) will be deleted permanently. Please pay attention to these issues before delete.

3.4 Users shall be responsible for his/her personal behaviors under the UID, and pay attention to the security of UID, including but not limited to the password and other relative information.

3.5 We have the right to disable, suspend, ban or delete user accounts, temporarily or permanently, when Users disobey local laws, regulations or our User Agreement.

Article 4. Payment

4.1 Freejoy is an application available to be download, install and use for non-commercial purpose. Currently we are not charging you for use of our Services and we reserve the right to adjust the way we operate.

4.2 Internet fees may be caused and charged by the mobile operator during the downloading and using of Freejoy. Users shall consult local mobile operators for details.

Article 5. Users' Obligations

5.1 Users represent and warrant to use Freejoy (i) legitimately and honestly, and (ii) without infringing any third party's legitimate rights and interests.

5.2 Users represent and warrant not to spitefully delete, change, add functions or data saved in the application, or designedly avoid or destroy technical measures of us for the protection of Freejoy. Users shall take all risks and responsibilities caused by their breach of this term. In case Users involve Freejoy into any illegal activities or breach the purpose of this Agreement, we have the right to stop providing services to Users immediately and reserve the right to investigate and affix the responsibilities of Users through judicial channels.

5.3 Users represent and warrant not to (i) imitate products and services for commercial purposes, (ii) copy or imitate design philosophy, interface, functions and charts of Freejoy, or (iii) modify or create other derivative products of Freejoy without the prior written approval of us.

5.4 Users shall not use Freejoy or its services to make, upload, copy, send, share contents that violate applicable laws.

5.5 Users shall take all responsibilities for compensation to Freejoy and/or others' losses caused by their breach of this Agreement. Should Freejoy take such responsibilities, Users shall compensate Freejoy for related costs and losses, including reasonable attorney's fees.

5.6 Users acknowledge that breach of any of the above representations and warranties or rules and/or notices of Freejoy may result in immediate termination of their use of Freejoy without any refund or prior notice.

5.7 Users agree to accept all information services provided by us while using Freejoy.

Article 6. Rights and Obligations

6.1 We have the right to modify and update Freejoy at any time based on the needs of operation and network environment.

6.2 In case Users breach this Agreement while using Freejoy and cause losses to Freejoy, Freejoy has the right to take measures, including but not limited to stopping licenses and services, restrictions for use, investigating and affix legal liability, etc.

6.3 Freejoy may, in its sole discretion, discontinue provision of Freejoy at any time without liability and/or notice to Users.

Article 7. Disclaimer and Liability Limitations

Users acknowledge that Freejoy shall not be liable for the following conditions, including but not limited to:

7.1 System problems caused by hurricanes, earthquakes, tsunamis, floods, electrical outages, war, terrorist attacks, etc. (“Event of Force Majeure”).

7.2 Service problems caused by hacker attack, telecom department technical adjustments or failures, website update, bank problems, etc.

7.3 Within the scope of permitted by law, Freejoy may not necessarily be responsible for any technical issues, such as (i) Freejoy has no technical bugs, or (ii) fixes all bugs of Freejoy. While, Freejoy cannot warrant the services meet all needs of every User.

7.4 The only solution to dissatisfaction with this Agreement or Freejoy is to stop using Freejoy.

Article 8. Language

User Agreement is written in English and may be translated into other languages. In the event of any conflict, ambiguity or inconsistency between the other language versions of the User Agreement and the English version, the English version shall prevail.

Article 9. Governing Law and Dispute Resolution

9.1 Users agree that this Agreement shall be governed by laws of Hong Kong. Any dispute unresolved shall be submitted to a competent court in Hong Kong.

9.2 Any term of this Agreement, for whatever reason, completely or partially invalid or unenforceable or in violation of any applicable laws, shall be deemed to be deleted. Other terms of this agreement shall remain valid and have binding force.
